Charged for car hire damage you didn't cause: how to dispute it

What to check when you are blamed for a scratch or damage you don't recognise, in Spain or abroad.

Start without a card. Check your documents before you decide.

If you are charged for damage to a hire car that you did not cause, start by comparing the paperwork from pick-up and return. Ask the company to identify the damage, when it found it and how it worked out the amount. Your complaint will be more specific if it explains which evidence contradicts the charge and which amount you want refunded.

Not recognising damage does not on its own prove that it was there before your hire. Nor does a photo of the damage, on its own, show when it happened.

What to check if you are charged for a scratch or damage you didn't cause

Put the evidence in date order: picking up the car, using it, returning it and being told about the charge. Check that everything refers to the same vehicle and the same damage. The European Consumer Centre in Spain (in Spanish) recommends inspecting the car and keeping the paperwork that records its condition. Ireland's consumer authority, the CCPC, puts it plainly: the company can only charge you for repairs where there is clear evidence that the damage occurred during your rental.

  • Contract and terms: the company you hired from, the cover, the excess and the items that can lead to charges.
  • Pick-up condition report: damage already recorded, where it is and any remarks. Do not confuse it with the booking.
  • Photos or videos: compare the panel, the wheel or the specific area. Keep the originals and their dates; a screenshot can lose information.
  • Return report: whether there was an inspection, who did it and what was recorded. A return without an inspection leaves questions to clear up.
  • Notice and proof of the charge: the item, date, amount and currency. Keep the company's emails as well.

If something is missing, ask for a copy of the report, the images used to attribute the damage to you and the document that explains the amount. If the notice came later, ask the company to explain the gap between the return and the inspection.

Fictional example: the same scratch is on the pick-up report

A company charges €320 for a scratch on the left-hand door. The pick-up report already shows a mark on that door, and an earlier photo seems to show it. The question is whether the location and the damage match. The complaint can attach both documents and ask the company to explain why it considers the damage new.

This example is not a real case and does not show that a complaint will succeed.

Don't confuse the charge, the deposit and the excess

The deposit is a guarantee; the excess is the part of the cost you are liable for under your cover. The amount claimed may include several items. Note the damage, handling fees and any other items separately, and ask for a breakdown.

If €1,000 was held and €320 has been deducted, the dispute is not necessarily about the €1,000. Check the transactions and any refund to work out how much money is missing. If the problem is that the deposit is still blocked, see the guide to car hire deposits.

How to dispute a damage charge with your evidence

  1. Identify the contract and the charge. Give the dates, branch, amount and currency in your private message to the company.
  2. Explain what you are disputing. For example: the damage is already on the pick-up report, the photos do not identify it, or the amount is not broken down. Say only what you can back up.
  3. Link each statement to a document. "The pick-up report shows this mark" is more useful than a general accusation of fraud.
  4. Ask for a specific outcome. Ask for a refund of the disputed amount, or for the documents needed to clarify it, such as the company's inspection reports and a breakdown of the repair costs.
  5. Keep your letter and proof of sending. Use an official channel of the company and keep its reply.

If the company rejects your complaint or does not resolve it

The next step depends on where the company is established, where you live and the circumstances of the case. There is no single route that works for every hire in the world.

  • If the company is in Spain: you can contact the local consumer information office (OMIC) or the regional consumer service. Spain's Ministry of Consumer Affairs explains the official complaint channels (in Spanish).
  • If the company has signed up to the European Car Rental Conciliation Service (ECRCS): the CCPC notes that you can take your complaint there once you have complained to the company and are unhappy with its response.
  • If you live in the EU, Iceland or Norway: the European Consumer Centre in your own country can help with a dispute with a trader based in another of these countries.
  • If you live in the UK: the UK International Consumer Centre helps UK consumers with disputes with traders abroad.

Common questions about hire car damage

Can I complain if I didn't take photos?

You can explain why you disagree and ask for evidence. The pick-up report, the return report and emails can also be relevant. Having no photos may limit what you can prove; do not make up for it with statements you are not sure are true.

Is a charge made after I returned the car always invalid?

Do not assume so. Check what the contract says, when the car was inspected and what documents the company provides. A delay is a point to clarify, not a guarantee of a refund.

Does this guide help if I hired the car outside Spain?

Organising the evidence is still useful. The terms and the complaint routes can change with the country and the company. ReclamaHoy accepts personal hires abroad by adults who live in Spain, and any personal hire in Spain, wherever you live.
